The Charade of Mass Incarceration

One needs to be very careful before accepting a premise as truth, especially when that premise is coming from far left field.  Add “mass incarceration” to the latest list of phrases invented in the effort to deceive.

Radical liberals love to invoke the likeness of Nazi’s on those who oppose them.  Obviously, the term mass incarceration suggests images of German soldiers herding Jews into boxcars, a shameful shock tactic that is not accidental, but used to displace your logic and replace it with emotion.  Leftists use the same tactic in labeling man-made climate change skeptics as “deniers”, again, attempting to equate challengers with holocaust deniers.  These despicable tactics alone should be enough to awaken even the deepest sleeper in suspecting the quality of the argument.  A sure sign is when logic and reason aren’t adequate to make the case.  Being jolted, literally, out of ones mind and into the irrational state of raw emotional reaction is the tactic, even to the point of equating black imprisonment with slavery.

Mass incarceration is nothing of the sort, but actually the legal system not succumbing to the politically correct theorem of the equality of outcomes.  This is how the left’s theory works, (and also illustrates why it needs emotion absent logic.)  Like Joe Biden famously said, “We’ll take facts over truth.”

Because blacks in America represent approximately 13 percent of the total population but occupy about 40 percent of the country’s jail cells, to the radical left, this is de-facto proof of racism.  If we are to accept this theorem as fact, then it must also follow that blacks and whites commit crimes in the same proportion.  If you however reject this supposition, then according to the radical left, you are the racist.

One glaring problem with this leftist theory is that it requires you to accept that the legal system must be, in its entirety, racist from bottom to top, street cops to the Supreme Court.  That can be the only plausible explanation because if whites and blacks are equally disposed to committing crime, the only way that blacks could outnumber whites in prison is by way of false accusations, false arrests, unfair trials, racist juries, dirty lawyers and uncaring and corrupt judges.

If you reject the notion of a totally corrupt legal system, then you’re left with some disturbingly glaring facts.  According to the Bureau of Justice Statistics, (BJS), black males are more than 5-times as likely to end up in jail as their white counterparts.  Rejecting the emotionally based premise of blatant and widespread racism leaves rational people with the stark and perhaps uncomfortable reality that blacks commit more crimes than whites do.

The NBA player roster is 74% black.  If you embrace the theory that blacks out numbering white in prison is proof of racism, then the NBA has that same problem in reverse.  How does the radical left explain this juxtaposition?  They don’t because they can’t.

Drivel Versus Dribble

 

Conservatives in America first and foremost see people as unique and special individuals and only secondarily as groups.  The Left prefers to categorize people into sub-sets of groups and downplays the concept of individuality, preferring instead to force people into categories, reducing them to a simple commodity.  The Left assigns sameness to groups at the expense of their uniqueness as individuals.

Where the Left sees blacks, women, the poor, the rich, the 1%, etc., Conservatives see individuals, each with unique qualities, specific challenges and all different sorts of potentials, problems and pitfalls.

The proof of this claim is easy to establish.

For example, the Left asserts the notion that because black students in a high school makeup 10% of the student body, expulsion rates higher than 10% are de facto proof of racism.  Similarly, the Left points to the fact that while blacks are approximately 13% of the US population, their incarceration rate of nearly 38% of the overall inmate population proves racism.

The only way to reach these conclusions is to view blacks as a monolithic group, no different from any other group, devoid of uniqueness, individuality or nuance.  It is a simplistic analysis completely absent of consideration for the person.

If the Left is right about this way of measuring institutional racism, the following should also be true.

The racial makeup of the National Basketball Association, (NBA) should be approximately 13% black, 18% Latino and 61% white because this is the percentage of these groups in the US population.  Major League Baseball should share the same statistics, as should professional golf, hockey, etc., if we are to accept this flawed notion that groups of people are monolithic.

How then does the Left explain that the NBA is actually 74% black, 2% Latino and only 23% white?  Baseball is 8% black, 29% Latino and 59% white.  Of the approximately 713 active players on the National Hockey League, about 32 are black, or 4.4%.

And finally, how would the Left possibly explain Tiger Woods?  Just this past weekend, golf fans all but abandoned every other player on the course to follow Woods to a second place finish.  How would the Left possibly explain Woods being the most revered golfer in history and one of the highest paid athletes of all times, black or white?

The NBA is under-represented by white and Latino players because the league seeks the best possible talent and it so happens that the black players are better.  While the Left is counting colors, the rest of us are seeing individuals.  Rules in schools and laws in society compel behaviors and demand consequences.  Whether expelled or incarcerated, if the process for determining this is applied fairly and equally, then color don’t matter.

Those who think otherwise are simply making excuses for poor performance, bad behavior and criminal activity, hiding behind the flawed and now disproven theory of racism by the numbers.

Sterling Fights Back

The original call should have been illegal offense before the squeaky clean NBA elite began posting up to the nearest camera in order to condemn Clipper’s owner, Donald Sterling.

Newly minted commissioner Silver’s post-haste “ready, fire, aim” reaction was clearly in contrast to the higher ranking second US President and founding father John Adams who said, “We are a nation of laws and not men.”

As vile and contemptible as one may view Sterling, the method of his undoing was illegal and therefore unusable beyond the court of public opinion, which has already ruled and has no appeal apparatus. California law forbids surreptitiously recording private conversations in private places, otherwise known as Intrusion on Seclusion.

If we are, as Adams suggests, a “nation of laws”, then Sterling’s comments are inadmissible in legal proceedings because of what is know in the law as the “Fruit of the Poisonous Tree Doctrine” or more formally, the Exclusionary Rule. This concept says that anything obtained illegally cannot be used to further a cause or to make a case, even if it leads to otherwise legal evidence. This obviously necessary rule discourages illegal behaviors in order to prosecute other illegal acts; the technical version of two wrongs don’t make a right.

What a just outcome we can expect. Sterling remains; mixed into the primordial goo that is the NBA culture of violence, gangs, profanity through rap and criminality. What perfect bedfellows, Sterling and this bunch of thugs. Years of litigation and millions spend on high-profile trail lawyers will yield a prevailing Sterling, very likely dead by the time this is all over. Those holier-than-thou left standing will be lining up to break-dance on his grave.
